WHO’S LIABLE FOR PAYING YOUR CAR’S SMASH REPAIR COSTS?

Car accidents are terrible situations for all parties involved. But there is a silver lining — for you, at least. In the event of a not-at-fault accident, the other driver is legally obliged to pay for your car repairs. Their obligation stands whether or not either of you has insurance.

If the at-fault driver has insurance, they may be able to make a car insurance claim to help cover the cost of your smash repairs. But if they don’t have a car insurance policy, they will have to pay out of their own pocket.

Following the motor vehicle accident, do not admit fault. Be sure to get the other driver’s contact and insurance details and document the evidence as best you can. Take plenty of pictures, and make sure you liaise with them through written correspondence. Since you do not have insurance, we recommend you seek legal advice and send the at-fault driver a Letter of Demand outlining the incident and your expectations, including:

  • The location, date and time of the accident
  • The amount owed for smash repairs and towing, alongside a quote from a reputable smash repair specialist

Your legal counsel will advise you on what other details you should include. However, we can provide a detailed quote for your vehicle repairs based on our comprehensive review of your car. Our 24/7 tow team is also ready to bring your wrecked car to our panel-beating garage.

SMASH REPAIRS WITHOUT A COMPREHENSIVE CAR INSURANCE POLICY

Typically, your insurer would liaise with the other driver’s insurance company on your behalf. Since you don’t have an insurer, we’ll be happy to do the job for you. If the at-fault driver is insured, our claims team will work with them and save you the hassle. However, if the other driver is uninsured, you will need to coordinate payments with them directly or seek advice from your legal counsel.

You can count on us to repair your smashed vehicle to pre-accident conditions. But that’s not all. We’ll give you the keys to a complimentary accident replacement vehicle so you don’t have to organise a rental car.

How can I prove the other driver was at fault for our accident?

The other driver’s blame in the accident will be clear if they’ve been driving unsafely. Their fault may be caused by:

  • Driving while intoxicated
  • Failing to follow road rules
  • Rear-ending your vehicle

Whatever their reason, you may have a case if they admit to fault or apologise for the accident. This is why it’s crucial that you take care not to acknowledge or accept blame at the time of the accident.

What details do I need to collect following the accident?

Collect the following details and evidence to the best of your ability:

  • The at-fault driver’s details (name, address, phone number, email, license and registration)
  • Photos and videos of the accident scene and damage to both cars
  • Witness contact details and statements
  • Police reports

All these details can help you to legally claim that the other driver is at fault and should pay for your smash repairs.

Just been in an accident? Let’s get started.

If you’ve just been in a not-at-fault accident and do not have insurance, you can start the process by uploading photos of your smashed vehicle for us to review. We can then get started on providing a detailed quote.
